[update] Apple gegen Samsung: Niederländisches Gericht erlässt europaweites Smartphone-Verbot für das Galaxy

Eine recht zeitige Entscheidung: Dem Gericht in Den Haag blieb bis zum 15. September für eine Entscheidung zu Apples eingereichtem Antrag bezüglich dem europaweiten Vertriebsstopp der Galaxy-Smartphone-Reihe.

The Rechtbank ’s-Gravenhage (a Dutch court in the city of The Hague) today issued an EU-wide preliminary injunction against Samsung’s Galaxy S, Galaxy S II and Ace smartphones — but not the Galaxy tablets — at Apple’s request.

The decision [einstweilige Verfügung] will take effect in seven weeks, i.e., mid October.

Im Geschmacksmuster-Rechtsstreit, betreffend die Galaxy-Tablets in Deutschland, ist ein mündlicher Verhandlungstermin für den morgigen Donnerstag angesetzt.

That’s actually super important, and you might characterize this as a mixed victory for Apple: the court ruled against Cupertino’s other patent and trademark claims at this juncture, and Florian Mueller says it cast a disparaging eye on some of Apple’s software patents as well.

Thus the court has decided that Samsung must fix this part (picture scrolling and showing parts of the next/previous picture) in the next 7 weeks. IF they fix it, so that the patent is not infringed upon, they are FREE TO SELL the Galaxy phones.
